PHOENIX (KSAZ) - Police say a valley woman intentionally threw a kitten from a third story balcony after it urinated on her carpet. That woman now charged with animal abuse after it died.

According to a police report, Patricia Gaffin admitted to police that she was a "cat killer" after throwing the weeks old kitten over her balcony.

"You've been arrested for animal cruelty a class six felony," said a judge.

Patricia Gaffin made her first appearance in court Tuesday after Phoenix Police say she threw a kitten off a third story balcony killing it.

"I would never hurt an animal," said Gaffin. The judge replied, "well, that's not what I'm reading here ma'am".

Speaking through tears Gaffin denies the allegations but police say they have witnesses who saw her throw the cat.

According to court paperwork, it happened at this apartment complex at 15th ave and mountain view the report goes on to say neighbors heard the woman arguing with her children and then threw it off the balcony after it urinated on her new carpet.

Gaffin has since been released from jail, but nobody answered the door at her apartment.

Nicole Ware lives next door, "at first I thought it was a shoe or what not, but then I walked over, and I seen it was a dead cat and I was pretty upset," she said.

The whole ordeal has neighbors mad. Especially a woman who says she adopted a cat from the same litter.

"It makes me upset but what can I do," she said.

The woman was told by the judge she is not allowed to have a pet for the time being. A dog the woman says is a service dog for her two children is allowed to stay in the home.
