PHOENIX (KSAZ) -

A Maricopa County judge has ruled that a 5 year-old boy from Mesa with multiple disorders including horrible seizures can be treated using marijuana extract oil.

The family has fought a battle with the State of Arizona after they said it was bizarre that they could give their child medical marijuana but not the oil.

FOX 10 talked to the family tonight about the new ruling.

"We're feeling very excited, we're thrilled right now, and we just can't wait until we can give him the medication that he needs," said Jennifer Welton.

Since October Jacob and Jennifer Welton have been working with the ACLU to fight the state to allow them to give their 5 year-old son Zander oil made from marijuana.

"He has cortical dysplasia, gross developmental delays, and epilepsy," said Welton.

After hearing about marijuana being able to treat these debilitating ailments they decided to try it for themselves the results, they say are life changing for Zander. His dangerous seizures dramatically reduced, and his mobility increased.

"He was having seizures every night every other night and they were long ones," she said.

Under state law, they can only give Zander the marijuana in plant form not oil.

They mash up the marijuana into applesauce. They say it's hard to determine exactly how much marijuana he's getting, and Zander doesn't like the taste.

But now with this new ruling a judge says the marijuana leaf is the same as the oil making it easier for the parents to measure and administer.

"For us it's always been about the quality of Zander's life and giving him the best life we possibly can as parents. That's our job, and if we have to fight for that then we're going to fight for it and we did and we won," said Welton.

They are meeting with doctors this week to begin talking about dosage and hope to start the marijuana oil treatment soon.
