Mother upset that son's alleged killer released on bond

ATLANTA -

The mother of a teen killed on a southwest Atlanta street corner is upset that the man who allegedly fired the fatal shot is back on the streets.

Wilton Smith Muirhead, 17, was struck by a bullet fired during an argument between two other men on Feb. 4.

"Wrong place at the wrong time," said Muirhead's mother, Tiwanna Smith.

Shortly after the crime, Atlanta police charged Darnell Hudson with several crimes, including felony murder and firearm possession by a convicted felon.

Hudson was a released on a $150,000 bond – a fact that doesn't sit well with Muirhead's mother.

"It's very painful. And it hurts because I have seen him numerous times," Smith said.

Smith is frustrated with the Fulton County District Attorney's Office and the judge who granted the bond in mid-July. She fears for the safety of her relatives who live near the murder suspect and said that she's spent the last few weeks trying to get answers.

"This is not the first time as a gun charge," Smith said. "This is not his first time in trouble. This is not his first time harming somebody. How can you look upon yourself and give this man a bond?"

Fulton County District Attorney Paul Howard issued a statement to FOX 5 that read, in part, "I empathize with the mother's fears and concerns. We believe the defendant is a dangerous criminal who should be in jail...which is why prosecutors vehemently opposed bond."

Judge Tom Campbell, who granted the bond, was unavailable to comment to FOX 5.

Howard says he will continue to seek justice for Muirhead.

Muirhead's mother is hoping prosecutors will get a bond revocation hearing for Hudson and make a case for sending him back to jail.

FOX 5 was unable to reach Hudson for comment.
