NEW YORK (MYFOXNY) -

A police investigation is underway into the death of a woman from the Upper West Side who went overboard a boat in the Hamptons over the weekend, but at this time it appears to be accidental.

The woman's husband told police he heard screaming for help and noticed his wife was in the water late Saturday.

John Petrocelli, 54, and his wife were boating off Montauk Point at approximately 12 a.m. when he says he noticed that his wife, Ninive Petrocelli, 39, was not on the boat.

Police said he notified the United States Coast Guard and they immediately conducted a thorough search of the area.

At approximately 11:30 a.m. on Sunday, a boater notified the Coast Guard of a possible body in the water off of Montauk Point. When the Coast Guard responded to that location they found and recovered the body of Mrs. Petrocelli, 40.

John Petrocelli, the co-owner of a construction company in Palisades Park, N.J., said his wife was not wearing a life preserver. He told police he threw all the boat's life vests into the water in an attempt to save her.Suffolk County Police say that Petrocelli's body was taken to the medical examiner's office for an autopsy to determine the cause of death.

Suffolk County Homicide Detective Lt. Jack Fitzpatrick said Monday there is "no obvious criminality" in the case, the AP reported. An autopsy and toxicology tests are being conducted.

Federal authorities say seven Long Island restaurants have agreed to pay nearly $1.7 million in back wages to 363 waiters and kitchen workers. The U.S. Labor Department says the restaurants - six in Suffolk and one in Nassau - were accused of paying workers below the federal minimum wage of $7.25 per hour. They also were accused of paying employees off the books, failing to pay time and a half for overtime and other violations.
