Partner testifies in former officer's murder trial

Testimony resumed in the trial against Richard Chrisman. The former Phoenix Police officer is accused of shooting and killing an unarmed man.

Thursday, Chrisman's partner was questioned about the shooting. He described it as an execution.

He told the jury he turned away for a few seconds just before the shooting because he didn't want to witness an execution.

"I was already in the trailer and then when Chrisman took his gun and put it to his head…" said Sergio Virgillo

Officer Sergio Virgillo was on the stand all day long, mainly questioned by defense attorneys about inconsistencies in what he told investigators right after the shooting and what he testified to Wednesday.

Attorney: "You stepped into the trailer at that point, isn't that what you told Detective Porter on October 5th?

Virgillo: "Yes but I believe you're taking it out of context."

Attorney: "Okay. It says [reading] ‘he pulls his service weapon puts it to his head and then returns it to his holster.' Detective Porter: ‘what happens then?'" Virgillo: ‘There was a struggle I stepped into the trailer at that point and tried to grab Danny's right arm.'"

The big question: was he standing outside or inside of the trailer when Daniel Rodriguez was shot? Defense attorneys say Virgillo didn't see the shooting. They claim he was standing outside because he was afraid of the dogs. They played a recorded interview Virgillo gave investigators just after the shooting.

Recording of Virgillo: "I was so worried about going inside because of the dog I thought that if I would get into this little area here this dog was going to come."

Virgillo says he kept his distance at first but stood at the doorway when he realized the dogs weren't a threat. He says he saw the shooting and the only person he was afraid of inside that trailer was Chrisman.

"When Chrisman put the gun to Daniel's head the way he did, who knows what could have happened to me."

The trial will continue on Monday.
