Police sergeants accused of assault and robbery released

Off-duty cops are accused of assault and robbery. It is alleged they pulled up in a truck with guns drawn and badges around their necks and stole a wallet and cell phone from a couple of guys at a Citgo gas station on Detroit's east side, pistol-whipping one of them in the process.

The two sergeants from Detroit and St. Clair Shores arrested Saturday were released Monday night because charges have not been filed against them.

"They're not rogue police officers. They weren't acting in a capacity as police officers, and they're highly decorated," said Todd Flood.

The attorney represents the sergeant from St. Clair Shores, an officer that has been honored with a distinguished service award for his work with the department where he has worked for 17 years.

His alleged partner in crime is a 20-year veteran of the Detroit Police Department. The two went to the academy together.

Sources have told Fox 2 the daughter of the St. Clair Shores sergeant was recently robbed of her cell phone, and the officers were trying to track down the men responsible.

"They weren't acting as police officers, but there's a bigger picture here, and a concerned father, obviously that's one aspect that a lot of people are going to want to leap to," Flood said.

However, the attorney said there is more to this, and the alleged victims are not being truthful.

"I don't necessary think what their story is, is accurate," he said.

Flood is also questioning the allegations by investigators that the off-duty sergeants had their badges around their necks.

"You can see there's some things that are not collaborating. I'm interested to see where those badges were. Obviously, that was a very poignant moment to say they had badges around their necks, but I don't see those in your pictures," he said.

A Good Samaritan snapped photos of the scene outside the gas station on July 21 that were later aired on Fox 2.

The allegations against these officers are obviously very serious. The Wayne County Prosecutor's Office told us they will be doing a full investigation and the case is still under review.
