TRENTON, N.J. -

A family is grieving the loss of a father after an accused drunk driver hit their car, head-on.

The horrible Father's Day tragedy happened in Trenton.

A 7-year-old boy remains in guarded condition at Capital Health Medical Center and his 4-year-old sister is clinging to life after a horrific crash in Trenton.

The man responsible for the crash, state police say, was driving drunk.

Investigators say 28-year-old Jorge DeLeon's silver Nissan Quest was hit head on by that suspected drunk driver.

DeLeon was driving North on Route 29 in Hamilton Township near Route 129 when he was hit by a Dodge Durango. The alleged drunk driver was driving on the wrong side of the road.

DeLeon died at the scene.

His 4-year-old daughter Jasmine was rushed to Children's Hospital of Philadelphia, where family tell us she's clinging to life.

Officials now say that Jasmine is brain-dead.

The 7-year-old survivor is a identified by family as Mario Luis DeLeon.

Through a translator, DeLeon's wife, Judy, says she's angry a drunk driver took away her husband.

"We just want justice for him," she said. "People need to stop drinking and driving because this can't keep happening to other people."

Friends gathered in Trenton this Father's Day to remember their friend, Jorge.

"Everybody here loved him. He was a good guy. Everybody cared about him. He was a good father," said a friend.

A 27-year-old man from Camden, Manuel Gutierrez Vazquez, has been charged with death by auto, operating a vehicle without a license, and DUI.

He's being held on a $250,000 bail. We are also told that US immigration and customs has a detainer on Gutierrez. They believe he may be an undocumented immigrant.
