The Gwinnett County Sheriff's Office says a mother lied to deputies as her suspect husband hid in an attic with her three children trying to evade arrest Tuesday.
Marvin Bailey was wanted on outstanding warrants for criminal trespass, third-degree cruelty to children and battery stemming from a domestic violence incident on May 26.
On Tuesday, deputies served the warrant at the woman's home where Bailey was known to frequent in the 3900 block of Satellite Boulevard, the Sheriff's Office said. Deputies said they could hear children crying inside of the apartment before they knocked. When they did, and announced their presence, the crying stopped and no one answered the door.
A sheriff's deputy got a key to the apartment from the leasing office and when he returned to the apartment, he observed a woman speaking to police officers who had arrived on scene to assist.
The woman -- identified as Philathea Knowles -- advised the deputy that she lives in the apartment and that no one was inside, the Sheriff's Office said. She denied that any children were inside the apartment and further advised that she did not have the key to her apartment.
Deputies then entered the apartment using the key provided by the leasing office.
Once inside, the deputies searched the apartment and did not locate anyone, but noticed that a chair had been placed below an open attic entrance. When deputies ordered Bailey to come out of the attic, a small child peeked out from the attic door.
The deputies safely removed the 4- year-old girl, who said her brother was also in the attic. The deputies then safely removed her 6-year-old brother from the attic. The children then said their father was in the attic, too.
A 1-year-old child was also discovered hidden under a blanket in the apartment.
A Gwinnett County Police K-9 unit arrived to the scene to assist. Marvin Bailey surrendered and was taken into custody without further incident.
Gwinnett County Sheriff's deputies obtained additional warrants charging Bailey with three counts of reckless conduct. Deputies also obtained a warrant charging Philathea Knowles, the children's mother, with obstruction of a law enforcement officer.
The children were released to a family member who was called to the scene. Bailey and Knowles were taken to the Gwinnett County Jail.
Bailey is being held with no bond and has a hold for Stone Mountain Police Department.
