Dairy Boy told by Macomb County to remove boulders on curb

ST. CLAIR SHORES, Mich. (WJBK) -

You hear all the time about homeowners telling neighborhood kids to stay off the lawn, but for a pair of business owners in St. Clair Shores, their battle is with buses and trucks.

Dairy Boy on Harper keeps getting hit with tire tracks in the front yard.

"It's just mortifying," said co-owner Cathy Peters.

The Dairy Boy says traffic turning off Harper, usually school buses headed to Rodgers Elementary next door, cuts the corner and continues to tear up the yard. Four years ago the corner was all concrete, but St. Clair Shores said let's turn it into a pocket park.

"We've got a short radius here going off from Harper onto Lanse for the buses to make the turn," said co-owner Joe Peters.

The pocket park consists of two benches and some lawn. St. Clair Shores paid to build the pocket park, but Dairy Boy warned buses and trucks will tear up the lawn. The school buses hit the curb and jump up in the air.

"You've got to take care of this corner because the buses will go three, four, five feet into the property," Joe said.

The Peters brought in boulders to act as a visual warning and physical reminder not to cut the corner. They said without the boulders, the corner pocket park will become a rut-filled mud bath.

"I want them to scale that corner back three to four feet so that the buses will have now plenty of room to move around the corner or cement it all back in," Joe said.

Macomb County contacted Dairy Boy and ordered the boulders removed.

"A lot of those big trucks come down there and they run over the corner. So he put some boulders there. They're pretty good size rocks, and you can't have rocks in the right away because it can impair a car or hurt somebody. We asked him to move the rocks," said county spokesperson Vince Viviano.

Macomb County is suggesting bright colored plastic sticks, which would be highly visible and collapse on impact.

"They run over my rocks, they're going to run over plastic sticks. I said, 'Put two children on a bench out there and they'll probably run over them, too,'" Joe said.

Dairy Boy is beyond the deadline to clear the rocks. They want some kind of safe solution, but right now they figure they're between a rock and a hard place.
