Detroit dad says he killed Rottweiler that attacked his son

Five-year-old Ricardo is recovering.  He has a lot of stitches after being bitten by a really big dog.  We're told a neighbor's Rottweiler had its way with Ricardo, and it's a Monday this sweetie pie and his parents won't forget.

"As my son was leaving out of the yard to get in his grandmother's truck, the dog grabbed my son's leg and was shaking his leg to where he fell and hit the ground. The dog [dragged] my son to the other dogs and had my son's face in his mouth and was shaking his face," said Lucinda Gavin.

"All I'm hearing is my son [saying] 'Mommy, help me.  Please, mommy, get him off me.  Mommy, get him off me.  Help me,'" she added.  "Blood just rushing everywhere, I instantly paniked."

As soon as he heard what happened, DePaul Simmons rushed to the scene in southwest Detroit.

"My wife was in the middle of the street hysterical.  He was sitting in the back of the truck.  He just started screaming, "Daddy," and I made them take him to the hospital, and from there I took over.  [The] police never came," he said.

"If it wasn't for me and his grandmother and his father, my son, God knows, would not be here breathing right now," Gavin said.

It was not over then, and it's still not over now because Simmons said he waited several hours to see what was going to be done with the dog that did this to his autistic son.  When he didn't see the law, he took the law into his own hands.

"I beat him with an axe," Simmons said, and hit the dog with his car, killing it in its own yard.  There were witnesses, and he didn't care.

"People [are] getting attacked by dogs every day, and to just let the dog still live and roam around to do it to another person, the next person might die," Simmons said.

Someone who watched him must have called the Michigan Humane Society.  They showed up and left a card on his door.

"They [were] looking for me because they [were] going to arrest me for killing a dog and nobody showed up to save my son," Simmons said.

Detroit Police are also investigating this father's fury.

"If they wanted some justice, they would have pulled up, they would've shot the dog [themselves].  I wouldn't have had to make it there first and do what I had to do," Simmons said.

"Any real parent would've done the same thing that he did.  Nobody else took the justice to take care of it, so he took it, and I love him to death for it," Gavin said.

"For them to be looking for me and not looking for the owner of this dog, and they know who it is, it's unjust.  If they want to take me to jail, take me to jail, but justice will be served on behalf of my son.  I promise you that," Simmons said.

Dad told us over and over that he did not see police officers or an ambulance, but I was told they both came within 24 minutes of the 911 call.

A warrant has not been signed.
