Judge refuses to quash Prescott murder case

PRESCOTT, Ariz. (AP) - Lawyers for a Prescott stockbroker accused of killing his ex-wife say they'll appeal a judge's refusal to either dismiss the charges or remove Yavapai County prosecutors from the case because they viewed defense documents not intended for them.

Visiting Judge Gary Donahoe's ruling Thursday denies requests by attorneys for Steve DeMocker.

DeMocker's Yavapai County Superior Court trial on charges that he killed his ex-wife, Carol Kennedy, in 2008 has been on hold pending proceedings related to the documents that were supposed to be sealed in court records.

Prosecutors allege DeMocker bludgeoned Kennedy with a golf club to avoid paying alimony, while DeMocker maintains that he is innocent.

The Daily Courier reports that DeMocker attorney Craig Williams says a special-action appeal will be filed with the Court of Appeals.
