The National Labor Relations Board will hear arguments Tuesday on the legality of the school bus driver and matron strike in New York City.

Nicole Gelinas of the Manhattan Institute weighed in on the board's possible decision during Good Day NY.

"The NLRB will rule on whether this private sector union has the legal right to strike. The board has a history of ruling either way in these things. It's an issue of public safety. It's the mayor's job to make sure the children have a consistent way to get to school," said Gelinas.

The strike entered its fourth day on Tuesday.

Striking workers are demanding job protection as the bus company's contracts go out to bid.
