TUCSON, Ariz. (AP) - Charges have been dismissed against a Tucson man involved in a crash that killed a motorcyclist two months ago.
The Arizona Daily Star says case against 44-year-old Francisco M. Villapando was dismissed at the request of a Pima County prosecutor.
Authorities say there's insufficient evidence to proceed with prosecution at this time because Villapando's blood tests were negative for drugs or alcohol.
Villapando was indicted Aug. 21 on manslaughter, criminal damage and aggravated driving under the influence charges along with seven counts of endangerment.
Authorities say 62-year-old John Kostelny was stopping at a red light on his motorcycle when he was rear-ended by a pickup truck Aug. 11 and dragged into two other vehicles. He died of his injuries.
