We've been following the case for two years, and now, a jury will decide Elizabeth Johnson's fate. Is she guilty of kidnapping?
Baby Gabriel has been missing since December 2009. Johnson at first claimed she killed the baby, but later told police she gave him away to a couple in San Antonio, Texas. She's on trial for kidnapping and custodial interference.
What gets lost in all the legal proceedings is the fact that Gabriel is still missing. He would be 3 and a half years old.
With his mother not knowing or not telling police exactly where the child is, it's not known if Gabriel will ever be found, dead or alive.
We spoke to Reporter Yami Virgin from the FOX affiliate in San Antonio, who's been covering this case from the beginning.
Does she think baby Gabriel is alive?
"My gut tells me that the baby is alive. That girl drove from Phoenix Arizona to San Antonio with a child that was ill, that was crying in the car, for what, an 18-20 hour drive here? I mean seriously. And then to get to San Antonio find a babysitter to take care of him, buy him new clothes, to go to the extent that she did as a mother to take care of that child. It just seems crazy to me that Elizabeth Johnson at the age of 23 back then, was smarter than the FBI, than the San Antonio Police Department... and every agency that has looked across the country for this 3 year old child," said Virgen.
And San Antonio Police appear to believe the child is alive and well.
"The official word here is this is still a missing persons case. Now they find any evidence the child is dead, the case will then move over to the homicide department. And they're telling me this is still a viable case."
Johnson could get up to 27 years in prison if convicted of kidnapping.
