Macomb Co. mom says teen daughter could face child porn charges

A Macomb County woman says her teen daughter could face child pornography charges if she pursues statutory rape charges against a 20-year-old man.
The woman, whose identity was concealed during an interview with FOX 2, says her daughter was 14 years old when she sent explicit photos and entered a romantic relationship with a 20-year-old family friend.
The mom says after she discovered the relationship, she contacted Macomb County prosecutors about pursuing rape charges. She was told if the case were to move forward her daughter, now 15, could face charges of creation and distribution of child pornography.
The girl, whose identity was also concealed, admits to sending nude photos to the man. "It was mostly him asking for them and I could have said no, but I didn't because I felt like I needed to or else he was going to go somewhere else."
"At 14, according to the law, she cannot consent to sex," says the mother. "So what makes us think that she can consent to sending him sexual photos?"
"I definitely regret it," says the teen.
Child Protective Services is involved in the case. Calls for further explanation from the prosecutor's office went unreturned on Wednesday. FOX 2 plans to follow up on Thursday.
