Victim's dad frustrated with delays in killers' sentencing

Sentencing for one of two men accused in an ASU student's murder was delayed again Tuesday morning.

The defendant refused to come to court.

This high profile murder case is that of ASU student Zachary Marco.

We were expecting Daniel Marco to unload on defendant, Marion Patterson, who has pleaded guilty to 2nd degree murder.

Instead, the father, whose son was murdered 21 months ago, focused on his frustration with the Maricopa County justice system.

The day Daniel Marco lay his son Zachary to rest he made a promise.

"When I pushed my son into the crematorium box the last word I said to him was I'm going to see this through to the end," says Marco.

He says Maricopa County's convoluted court system has made it difficult to seek justice for his son.

"It's a slow form of torture. It's like Chinese water torture. The first five drops aren't that bad but when you get to the 20th and 30th one it really begins to hurt."

Marion Patterson and Louis Harper are accused of shooting and killing Zachary Marco on October 17, 2010 as he walked home from ASU library.

Marco says the system prosecuting his son's killers isn't working.

"We have more hearings here that have no purpose. The only purpose is to set the next hearing date."

"It's broken and it needs to be fixed. Someone's got to look at it, I doubt that they will but they should," he says.

Actually, the Supreme Court is looking at it. A newly formed commission will examine how Maricopa County court case times.

"When a court case is going through the process is it being done in the most efficient way possible? Is the case moving quickly and efficiently through the system?" says Jennifer Liewer, Arizona Supreme Court.

Liewer said she gets the pain and frustration these families must be feeling as they go through the process.

She says these capital murder cases can be very complex, it's a delicate balance of speed and justice is challenging.

Meanwhile, the next court hearing for the Marco murder trial is august 8th. The alleged shooter Louis Harper has a pretrial conference.
