PHOENIX - The Colorado woman accused of squeezing a TSA agent's breast at Sky Harbor airport will not face felony charges.
Maricopa County Attorney Bill Montgomery belives this incident is not sex abuse.
Yukari Miyamae could still face a misdeameanor charge - that's up to city prosecutors.
TSA officials also say this all happened because the woman didn't want to go through a body scanner for fear of getting cancer.
"I'm commuting from Colorado to Phoenix every week and for the job that I'm currently working with, I'm a translator," said Miyamae.
The 61-year-old faced a judge after being arrested on Thursday.
TSA officials say she became angry while waiting in line to go through a body scanner at Terminal 4.
TSA agent Barbara O'Toole was brought in to explain Miyamae's options.
According to the TSA, Miyamae told O'Toole if she went through the body scanner and got cancer, she would hold her personally responsible. O'Toole suggested Miyamae could go through a pat-down and that's when Miyamae allegedly grabbed O'Toole's breast and said, "Oh, like this."
After her arrest, a judge let Miyamae go without bond, saying "I'm unable to make a finding of probable cause that you commit sex abuse, so I'm going to release you okay, yes."
The judge then told Miyamae to avoid contact with O'Toole.
"I commute and I go through the program that I had was with TSA," said Miyamae.
Miyamae's attorney tells FOX 10 she's the victim and was traumatized by all of this.
A Facebook page has popped up to help pay for her legal defense.
Her case is now being handled by the city prosecutors office. They could decide to charge her with a misdemeanor, if they decide to charge her at all.
