PRESCOTT - Robert Denoyelles was Tased outside a Golden Corral restaurant in Prescott, and the whole thing caught on tape.
Today, we spoke with the man's wife and are getting a look at the police report, which paints a much different picture of what happened.
Still -- the Yavapai County Attorney's Office is dropping that resisting arrest charge.
A tribal police officer says he was forced to Tase the 41-year-old. According to a Yavapai Prescott Tribal Police Report, several people called 911 to report that Denoyelles was standing outside the Golden Corral in Prescott, harassing customers, asking for food, money, and yelling at them.
The officer who Tased him says he told Denoyelles to turn around seven times after putting his hands up.
Denoyelles refused, and the officer says he had no choice but to Tase him. Denoyelles is 6 feet 6 inches tall, and weighs more than 250 pounds.
We have pictures taken just after he was Tased.
"I thought they had no reason to do it, it was wrong," says wife Katie Denoyelles. She says her husband has mental health issues. She and a friend are trying to get him help.
"He's kind of handicapped… I know lately he's been disoriented," says Katie's friend.
The police report claims Denoyelles kept referring to three different personalities after his arrest, even asking who the charges were for.
He was taken to jail for resisting arrest. That charge has since been dropped by the county attorney -- instead Denoyelles will face a disorderly conduct charge.
There's no explanation given as to whether the county's decision to downgrade his charge had to do with his mental health issues.
Denoyelles was released from jail Tuesday afternoon.
