PHOENIX - A valley Subway restaurant that violated the Employer Sanctions Act has settled with the Maricopa County Attorney.
The owner of Danny's Subway, at 19th Ave and Indian School, agreed to close for two business days, must submit quarterly reports on new hires, and will be on probation for three years.
According to ICE, an illegal worker was employed at Danny's Subway between Jan. 2007 and July 2008. When the restaurant was notified of the worker's immigration status, the employee was fired in July 2008.
But ICE says Danny's rehired the employee in Sept. 2008 under a forged identity. When ICE learned of the rehire, they arrested the employee, fined the company $431, and began administrative proceedings against the company.
ICE then referred to the Maricopa County Attorney for civil prosecution.
Tuesday, the settlement agreement was filed with the superior court. Danny's Subway will have to submit quarterly hiring reports during the next three years and close for business for two days.
