Prescott Pays $45K to Man Hit by Police Cruiser

PRESCOTT, Ariz. (AP) -- The city of Prescott has agreed to pay a pedestrian hit by a police car $45,000 to settle a lawsuit.

Officer Jon Marshall hit the 23-year-old man as he crossed a street in a crosswalk last January.

Eli Linscott suffered leg fractures and was off work for 12 weeks.

He had originally sought $100,000 from the city for medical bills, lost wages and pain and suffering. The Prescott Daily Courier reports that the City Council approved the settlement Tuesday.

The police investigation concluded that Marshall was blinded by glare from the sun.

The investigating officer cited Linscott for violating a pedestrian control signal, but the charge was dismissed in Prescott Magistrate Court.

The city's insurance carrier negotiated the settlement.
